Operated by: Akhil Anand (AtlasBurn), an individual based in Kanpur, Uttar Pradesh, India

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of AtlasBurn ("AtlasBurn," "we," "us," "our"), including our software, dashboards, SDK components, analytics tools, website, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be legally bound by these Terms.

If you do not agree, you must not use the Services.

2. Description of Services

AtlasBurn provides predictive analytics, forecasting models, and cost visibility tools designed to help organizations:

  • Monitor AI/API usage patterns
  • Model runway compression scenarios
  • Detect burn volatility
  • Generate optimization signals

AtlasBurn is:

  • Not a financial institution
  • Not a licensed investment advisor
  • Not an accounting firm
  • Not a replacement for independent financial or legal review

All outputs are informational and probabilistic in nature.

3. Eligibility

You must:

  • Be at least 18 years old or have lawful authority to bind an organization
  • Use the Services in a commercial or professional capacity
  • Have authority to agree to these Terms on behalf of your company

If you are entering into this agreement on behalf of an organization, you represent that you are authorized to bind that entity.

4. SDK & Data Processing Model

AtlasBurn may provide:

  • Local SDK components
  • Dashboard simulation models
  • API usage ingestion modules

Unless explicitly agreed in writing:

  • No API keys are stored by AtlasBurn
  • Sensitive credentials remain under Customer control
  • Customers are responsible for securing their own infrastructure

AtlasBurn operates as an analytics and modeling layer. We do not execute transactions on your behalf.

5. Customer Responsibilities

Customer agrees to:

  • Provide accurate and lawful data
  • Maintain internal access controls
  • Independently verify forecasts and projections
  • Use outputs responsibly

Customer acknowledges:

Predictive outputs are estimates based on probabilistic modeling and may not reflect future performance.

6. No Guarantee of Financial Outcomes

AtlasBurn does not guarantee:

  • Profitability
  • Cost reduction
  • Margin preservation
  • Runway extension
  • Revenue stability

All analytics are directional tools, not guarantees.

You remain solely responsible for business and financial decisions.

7. Fees & Payments

If the Services are provided on a paid basis:

  • Fees are non-refundable unless otherwise agreed
  • Subscription terms will be specified separately
  • Failure to pay may result in suspension

Taxes, including GST/VAT, are Customer responsibility unless required otherwise by law.

8. Intellectual Property

All intellectual property in the Services, including:

  • Algorithms
  • Forecasting models
  • Interface design
  • Analytics framework
  • Branding

remains the exclusive property of AtlasBurn.

No license is granted except as expressly provided.

SDK Carve-Out

The @atlasburn/sdk client library is licensed separately under the Apache License, Version 2.0. The proprietary-IP and "no license granted" clauses in this Section 8 do not apply to @atlasburn/sdk; use of the SDK is governed by the terms of its Apache-2.0 license as published in its source repository.

8A. Data Usage & Cross-Customer Benchmarking

AtlasBurn may generate and use aggregated, k-anonymized, de-identified telemetry derived from Customer usage metadata to produce cross-customer benchmarks (for example: median cost-per-call ranges by model, retry-rate distributions, runway-compression base rates). Participation is off by default and requires the organization's explicit opt-in via Settings → Data.

In all cases:

  • No raw events, prompts, model outputs, identifiers, or per-tenant records leave the tenant boundary.
  • Aggregations require a minimum cohort size (k ≥ 5 organizations) before any statistic is published.
  • Participation requires affirmative opt-in (Settings → Data); an organization can withdraw (opt out) at any time from the same screen or by emailing [email protected].
  • Treatment of this data is consistent with, and further described in, the AtlasBurn Privacy Policy.

9. Confidentiality

Both parties agree to protect confidential information disclosed during the course of use.

Confidential Information does not include information that:

  • Is publicly available
  • Was independently developed
  • Is required to be disclosed by law

10. Data Security

We implement commercially reasonable safeguards.

However, no system is completely secure.

Customer is responsible for:

  • Securing their infrastructure
  • Proper credential management
  • Access governance

11. Limitation of Liability

To the maximum extent permitted by law:

AtlasBurn shall not be liable for:

  • Indirect damages
  • Lost profits
  • Business interruption
  • Revenue loss
  • Data loss
  • Third-party service outages
  • API provider pricing changes

Total aggregate liability shall not exceed the amount paid by Customer in the preceding 12 months.

12. Indemnification

Customer agrees to indemnify AtlasBurn against claims arising from:

  • Misuse of the Services
  • Regulatory violations
  • Unauthorized use
  • Improper reliance on probabilistic outputs

13. Third-Party Services

The Services are designed to monitor AI/API usage across third-party model providers that the Customer integrates with, including but not limited to:

  • OpenAI
  • Anthropic
  • Google (Gemini / Vertex AI)
  • Cohere
  • AWS Bedrock

These are AI providers the Customer calls through their own credentials — AtlasBurn observes metadata only and does not proxy prompts or outputs. Infrastructure subprocessors used to operate the AtlasBurn platform itself (hosting, datastore, edge, auth) are listed in the AtlasBurn Privacy Policy and may be updated from time to time.

We are not responsible for:

  • Pricing changes
  • Service interruptions
  • API behavior
  • Policy changes

14. Termination

Either party may terminate:

  • With written notice
  • For material breach

Upon termination:

  • Access will be revoked
  • Data retention handled per Privacy Policy

15. Governing Law

These Terms are governed by the laws of: India

Disputes shall be subject to the exclusive jurisdiction of courts located in Kanpur.

16. Arbitration (Optional Enterprise Clause)

Disputes may be resolved via binding arbitration in accordance with applicable arbitration laws.

17. Force Majeure

We are not liable for delays caused by:

  • Government actions
  • Infrastructure outages
  • Force majeure events
  • Regulatory changes

18. Modifications
